These Terms of Use ("Terms") apply to gobrandspot.com and the BrandSpot alerts and services (together, "BrandSpot"), operated by [LEGAL ENTITY NAME] ("we", "us"). By using BrandSpot you agree to these Terms. If you don't agree, please don't use BrandSpot.

1. What BrandSpot is

BrandSpot is an independent guide to in-store roadshows, demos and events at Costco warehouses and similar retailers. BrandSpot is an independent service, not affiliated with or endorsed by Costco Wholesale. Costco and other retailer names are trademarks of their owners and are used only to identify where events take place.

2. Listings are information, not guarantees

Listings come from public retailer schedules and from brands. Each listing shows its source. Events can be changed, moved or cancelled without notice, and we can't guarantee that any listing is complete, current or accurate. Check with the warehouse or brand before making a special trip. Offers, prices, rebates and products are provided by the brands and retailers, not by BrandSpot.

3. Alerts by email and text

If you sign up for alerts, we'll send roadshow alerts for the ZIP code you give us, generally once a week.

• Text messages: By checking the consent box, you agree to receive recurring automated marketing text messages from BrandSpot at the number you provide, up to 1 message per week. Consent is not a condition of any purchase. Message and data rates may apply. Reply STOP to cancel at any time; reply HELP for help or email hello@gobrandspot.com. Carriers are not liable for delayed or undelivered messages.

Only sign up with a phone number or email address that you own or are authorized to use.

4. Brand listings and paid packages

Any brand may submit a free listing. By submitting a listing you confirm that the information is accurate, that you're authorized to submit it, and that you have the rights to any text, images or logos you provide, and you give us permission to display them on BrandSpot and in our alerts and social posts. We may edit, decline or remove any listing, including to keep listings accurate.

Paid promotion (such as featured placement, ads or content) is provided only under a separate written order that sets out the price, deliverables and dates. If that order conflicts with these Terms, the order controls. Results from advertising are not guaranteed. Roadshow staffing and booth management are not part of BrandSpot.

5. Acceptable use

Don't misuse BrandSpot. For example, don't submit false or misleading listings, interfere with the site's operation, try to access accounts or data that aren't yours, or use automated tools to copy the site in a way that places an unreasonable load on it.

6. Links to other sites

Listings link to brands' own websites. We don't control those sites and aren't responsible for their content, products or practices.

7. Our content

The BrandSpot name, logo and site design are ours. Facts about events belong to no one; brand names and logos belong to their owners.

8. Disclaimers

BrandSpot is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.

9. Limitation of liability

To the fullest extent permitted by law, we won't be liable for any indirect, incidental, special or consequential damages, or for lost time, travel costs or lost profits, arising from your use of BrandSpot. Our total liability for any claim relating to the free services is limited to $100. Some places don't allow these limits, so they may not apply to you.

10. Changes

We may update these Terms. We'll change the date at the top when we do, and the updated Terms apply from that date. If a change materially affects text alerts, we'll tell subscribers.

11. Governing law

These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in [COUNTY, STATE].
